29 CFR 1926.501(b)(1): Each employee on a walking/working surface with an unprotected side or edge which was 6 feet (1.8 m) or more above a lower level was not protected from falling by the use of guardrail systems, safety net systems, or personal fall arrest systems. a) Sunset Village Apartments, Building 9, Dover, DE 19904: On or about June 8, 2023, CSHO observed subcontractors/employees performing air conditioning/ducting installation work on several units of the multi-family apartments that was still being constructed. The subcontractor/employee was working at a height of approximately 12 feet above the ground level without any means of fall protection while using the exterior stairs that had the guardrail removed for siding installation.
