29 CFR  1926.501(b)(13):"Residential construction." Each employee engaged in residential construction activities 6 feet (1.8 m) or more above lower levels shall be protected by guardrail systems, safety net system, or personal fall arrest system .  The employer is failing to protect employees from fall hazards.  This was most recently documented on or about June 8th, 2023, at 11222 South 167th Street Court, Gretna, Nebraska 68028.  An employee was observed working at heights greater than 6ft without fall protection.    Leonels  Construction was previously cited for a violation of this occupational safety and health standard or its equivalent standard 1926.501(b)(13), which was contained in OSHA inspection number 1412523, citation number 2, item number 2and was affirmed as a final order on 8-12-2019, with respect to a workplace located at 13901 Tregaron Ridge Ave, Bellevue, Nebraska.   Leonels  Construction was previously cited for a violation of this occupational safety and health standard or its equivalent standard 1926.501(b)(13), which was contained in OSHA inspection number 1368085, citation number 1, item number 2and was affirmed as a final order on 5-15-2019, with respect to a workplace located at 2901 Fletcher Ave, Lincoln, Nebraska.

29 CFR  1926.1053(b)(1): Where portable ladders were used for access to an upper landing surface and the ladder's length allows, the ladder side rails did not extend at least 3 feet (.9 m) above the upper landing surface being accessed:  The employer is failing to protect employees from fall hazards.  This was most recently documented on or about 6-8-23 at 11222 South 167th Court Street, Gretna, Nebraska 68028.  An employee used an extension ladder for access to the lower level of the residential structure.  The ladder did not extend at least 3 feet above the upper landing surface.     Leonels Construction was previously cited for a violation of this occupational safety and health standard or its equivalent standard 1926.501(b)(13), which was contained in OSHA inspection number 1412523, citation number 1, item number 1and was affirmed as a final order on 8-12-2019, with respect to a workplace located at 13901 Tregaron Ridge Ave, Bellevue, Nebraska.

29 CFR  1926.503(b)(1):The employer shall verify compliance with paragraph (a) of this section by preparing a written certification record. The written certification record shall contain the name or other identity of the employee trained, the date(s) of the training, and the signature of the person who conducted the training or the signature of the employer. If the employer relies on training conducted by another employer or completed prior to the effective date of this section, the certification record shall indicate the date the employer determined the prior training was adequate rather than the date of actual training.  The employer failed to provide  a written certification that he trained his employees on the use of fall protection.  This was most recently documented on or about 6-8-23 at 11222 South 167th Court Street, Gretna, Nebraska 68028.
