29 CFR 1910.28(b)(1)(i):  Except as provided elsewhere in this section 29 CFR 1910.28, the employer did not ensure that each employee on a walking-working surface with an unprotected side or edge that is 4 feet (1.2 m) or more above a lower level is protected from falling by one or more of the systems described in 29 CFR 1910.28(b)(1)(i).  On or about June 8, 2023, Ullman Oil Company LLC at the location of 120 East Lake St. Ravenna, OH 44266, drivers were exposed to fall hazards of 4 feet or greater more above a lower level at both the east and west side loading and unloading rack. When loading fuel, drivers  stand and walk on top of fuel tanker trucks approximately 9 feet  4 inches above lower level and were not protected by one or more of the systems described in 29 CFR 1910.28(b)(1)(i).

29 CFR  1910.106(f)(5)(i): This paragraph (f)(5)(i) shall apply to areas where Category 1 or 2 flammable liquids, or Category 3 flammable liquids with a flashpoint below 100 �F (37.8 �C), are stored or handled. For areas where only Category 3 flammable liquids with a flashpoint at or above 100 �F (37.8 �C) or Category 4 flammable liquids were stored or handled, the electrical equipment was not installed in accordance with the provisions of Subpart S of this part, for ordinary locations.  On or about June 8, 2023, Ullman Oil Company LLC at the location of 120 East Lake St. Ravenna, OH 44266, the employer failed to ensure equipment used by drivers conducting loading/unloading operations at the west side loading and unloading rack equipment were in accordance with the provisions of Subpart S of this part.  Drivers were tasked to utilize their personal cell phone and/or smartwatch at the west side loading and unloading rack, to maintain and time proper flow rates of Category 1 or 2 flammable liquids, or Category 3 flammable liquids to include but not limited to gas, kerosene, diesel, dyed diesel, clear diesel and heating oil, due to flow meters being located within the underground storage tank pits and not visible to drivers during loading/unloading operations.

29 CFR  1910.1200(f)(6)(ii): Except as provided in 29 CFR 1910.1200(f)(7) and 29 CFR 1910.1200(f)(8), the employer did not ensure that each container of hazardous chemicals in the workplace was labeled, tagged or marked with the product identifier and words, pictures, symbols, or combination thereof, which provide at least general information regarding the hazards of the chemicals and which, in conjunction with the other information immediately available to employees under the hazard communication program, would provide employees with the specific information regarding the physical and health hazards of the hazardous chemical  On or about June 8, 2023, Ullman Oil Company LLC at the location of 120 East Lake St. Ravenna, OH 44266, drivers were loading and unloading hazardous chemicals to include but not limited to gas, kerosene, diesel, dyed diesel, clear diesel and heating oil into and from underground storage tanks without the benefit of a labeling system to identify the product and the associated hazards. The underground storage tank transfer points and OPW dispensers to include the switch panels at both the east and west side loading and unloading rack were mislabeled and/or lacked the appropriate hazard communication information.
