29 CFR 1926.451(b)(2): Except as provided in paragraphs (b)(2)(i) and (b)(2)(ii) of this section, each scaffold platform and/or walkway was not at least 18 inches (46 cm) wide: At a worksite located at 23001 SE Outer Rd, Peculiar, MO 64078: Employees were exposed to fall hazards. This was last demonstrated on June 8, 2023, when an employee was observed using the guardrails of the platform basket to gain access to the roof. The employee was exposed to heights of 12 feet to the ground below. Employees were not protected from falls by using guardrail systems, safety net systems, personal fall arrest systems, positioning device systems, or fall restraint systems. Such exposure is likely to cause serious physical harm or death.

29 CFR 1926.451(c)(2)(v): The employer used forklifts to support scaffold platforms without ensuring that the entire platform was attached to the fork and that the forklift was not moved horizontally while the platform was occupied: At a worksite located at 23001 SE Outer Rd, Peculiar, MO 64078: The employer failed to protect employees from exposure to fall hazards. This was most recently demonstrated on or about June 8, 2023, when a wooden platform approximately 2 ft x 2 ft was placed on the forks of a rough terrain fork truck and utilized to lift personnel to the roof section of the structure. The platform and materials onboard were lifted into position near the roof area, and an employee was standing on the platform passing materials to another employee. The platform could shift and tip, resulting in the employee being ejected and falling approximately 17 feet to the ground below. The platform was not secured to the forklift.

At a worksite located at 23001 SE Outer Rd, Peculiar, MO 64078: The employer failed to protect employees from potential fall hazards. This was most recently demonstrated on or about June 8, 2023, when employees were roofing a metal building and were working at a height of 17 feet without any fall protection. Employees were not protected from falling by using guardrail systems, safety net systems, or personal fall arrest systems.
