29 CFR  1926.28(a): The employer did not require the wearing of appropriate personal protective equipment in all operations where there was an exposure to hazardous conditions or where this part indicates the need for using such equipment to reduce the hazards to the employees.  On or about June 12, 2023, Luciano Benitez Nolasco and Misael Benitez Dominguez did not require employees to wear foot protection such as puncture-resistant boots when exposed to puncture and laceration hazards while roofing and clearing debris. Nails were embedded in shingles on the roof and debris on the ground in a worksite at 5415 Finkman Street in St. Louis, Missouri. Employees were allowed to wear tennis shoes that did not protect their feet from puncture and laceration hazards.
