29 CFR  1926.200(g)(2): All traffic control signs or devices used for protection of construction workers shall conform to Part VI of the Manual of Uniform Traffic Control Devices (AMUTCD"), 1988 Edition, Revision 3, September 3, 1993, FHWA-SA-94-027 or Part VI of the Manual on Uniform Traffic Control Devices, Millennium Edition, December 2000, FHWA, which are incorporated by reference. The Director of the Federal Register approves this incorporation by reference in accordance with 5 U.S.C. 552(a) and 1 CFR part 51.   On or about June 8, 2023, employees working in and near the roadway were not provided with Uniform Traffic Control Devices, exposing employees to struck-by hazards.  Abatement documentation is required of this item in accordance with the requirements of 29 CFR 1903.19(d).

29 CFR  1926.300(b)(1): When power operated tools are designed to accommodate guards, they shall be equipped with such guards when in use.  On or about June 8, 2023, employees used a power operated  handheld  tool without the guard, exposing employees to an amputation. 29 CFR  1926.651(d): Exposure to vehicular traffic. Employees exposed to public vehicular traffic shall be provided with, and shall wear, warning vests or other suitable garments marked with or made of reflectorized or high-visibility material.  On or about June 8, 2023, employees exposed to vehicular traffic were not wearing high-visibility garments, exposing employees to struck-by hazards.   Abatement documentation is required of this item in accordance with the requirements of 29 CFR 1903.19(d).

29 CFR  1926.651(c)(2):Means of egress from trench excavations. A stairway, ladder, ramp or other safe means of egress shall be located in trench excavations that are 4 feet (1.22 m) or more in depth so as to require no more than 25 feet (7.62 m) of lateral travel for employees.  On or about June 8, 2023, employees working in a 4 foot deep trench did not have a safe means of access, exposing employees to the hazards associated with not having safe access to a trench.   trenching hazards.
