29 CFR 1926.601(b)(4)(i): The employer used motor vehicle equipment that had an obstructed view to the rear, and did not have a reverse signal alarm audible above the surrounding noise level: a) On or about 06/07/2023 at a paving project located on Interstate 90, westbound, near mile marker 400, Pembroke, New York; employees performing milling and paving operations on the New York State Thruway were working around dump trucks that were backing up to milling machines and paving machines. A dump truck backing up to a paving machine struck an employee standing behind the truck. The dump truck did not have an operating back-up alarm. NO ABATEMENT CERTIFICATION REQUIRED

29 CFR 1926.601(b)(4)(ii): The vehicle was backed up without the observer giving the signal that it was safe to do so: a) On or about 06/07/2023 at a paving project located on Interstate 90, westbound, near mile marker 400, Pembroke, New York; employees performing milling and paving operations on the New York State Thruway were working around dump trucks that were backing up to milling machines and paving machines. A dump truck backing up to a paving machine struck an employee standing behind the truck. The dump truck backed up without the aid of a spotter to ensure the blind spot was clear. NO ABATEMENT CERTIFICATION REQUIRED
