29 CFR  1926.651(e): The employer does not prohibit employees from being underneath loads handled by lifting or digging equipment:  (a)SiteWorks Inc. at the intersection of 1st Avenue and Academy Street, Lennox, SD 57039: The employer routinely fails to prohibit employees from being underneath loads handled by lifting of digging equipment as demonstrated on or about and at times prior to June 9, 2023, The employer did not ensure that each employee conducting work in an excavation was prohibited from working underneath loads handled by an excavator.  This condition exposes employees struck-by and crushed-by hazards when performing work in excavations beneath loads handled by lifting or digging equipment.

29 CFR  1926.652(c): Design of support systems, shield systems, and other protective systems.  The employer or its designee does not select and construct support systems, shield systems, and other protective systems with designs in accordance with the requirements of paragraph (c)(1); or in the alternative, paragraph (c)(2); or in the alternative, paragraph (c)(3); or in the alternative, paragraph (c)(4) as follows:   (a)SiteWorks Inc. at the intersection of 1st Avenue and Academy Street, Lennox, SD 57039: The employer routinely fails to ensure that each employee conducting work in an excavation was protected by protective systems that were selected from, and in accordance with manufacturer's tabulated data, other tabulated data, or design by a registered professional engineer.  This was demonstrated on or about and at times prior to June 9, 2023. This condition exposes employees to cave-in and struck-by hazards when performing work inside of protective systems which were not evaluated by a registered professional engineer.

29 CFR  1926.652(a)(1): The employer does not protect employees in excavations from cave-ins by adequate protective systems designed in accordance with 29 CFR 1926.652 (b) or (c):  (a)SiteWorks Inc. at the intersection of 1st Avenue and Academy Street, Lennox, SD 57039: The employer routinely fails to ensure that employees conducting work in excavations are protected from cave-in hazards.  This was demonstrated on or about and at times prior to June 9, 2023, when employees working in excavations were not protected from cave-in hazards while installing sanitary sewer lines, in that the excavation was measured greater than five feet deep and lacked a protective system, such as appropriate sloping, benching, or shield system.   This condition exposes employees to cave-in and struck-by hazards when performing work in the unprotected excavation.  SiteWorks Inc.  was previously cited for a violation of this occupational safety and health standard or its equivalent standard, which was contained in OSHA inspection number 1615990, citation number 1, item number 1a and was affirmed as a final order on June 12, 2023, with respect to a workplace located at the intersection of 41st Street and Valleyview Road, Sioux Falls, SD 57106.  SiteWorks Inc.  was previously cited for a violation of this occupational safety and health standard or its equivalent standard, which was contained in OSHA inspection number 1578341, citation number 2, item number 1a and was affirmed as a final order on July 26, 2022, with respect to a workplace located at the North Oaks Avenue Addition, Harford Industrial Park Sewer Extension Project, Hartford, SD 57033.  SiteWorks LLC was previously cited for a violation of this occupational safety and health standard or its equivalent standard, which was contained in OSHA inspection number 1257122, citation number 1, item number 4a and was affirmed as a final order on June 11, 2018, with respect to a workplace located at the intersection of Arrowhead Parkway and South Powder House Road, Sioux Falls, SD 57110.
