29 CFR  1926.451(c)(3): Supported scaffold poles, legs, post, frames, and/or uprights were not plumb and braced to prevent swaying and displacement:   a)  Back of Residential Structure, 268 Dutchman's Point Road, Brick Township NJ: Employees assisting with the installation of roof shingles, and other related activities, from a mixed component aluminum pump jack scaffold system were exposed to fall hazards when the three poles supporting the scaffold were visibly not plumb and level. One pole was out of plumb approximately 7 inches  over 44 inches of vertical height. Condition observed on or about 06/13/23.  NOTE:  IN ADDITION TO ABATEMENT CERTIFICATION, THE EMPLOYER IS REQUIRED TO SUBMIT ABATEMENT DOCUMENTATION FOR THIS ITEM, FAILURE TO COMPLY WILL RESULT IN AN ADDITIONAL PENALTY OF $1000.00 IN ACCORDANCE WITH 29 CFR 1903.19.

29 CFR  1926.451(f)(3): Scaffolds and scaffold components were not inspected for visible defects by a competent person before each work shift, and after any occurrence which could affect a scaffold's structural integrity:   a)  Back of Residential Structure, 268 Dutchman's Point Road, Brick Township NJ: Employees assisting with the installation of roof shingles, and other related activities, from a mixed component aluminum pump jack scaffold system that was not inspected for visible defects prior to beginning work were exposed to fall hazards up to and in excess of 22 feet to the ground surface below.  The scaffold's screen was not attached to the scaffold's walking and working surface its entire length, the scaffold's work rest was not connected to its supporting bracket, the poles of the scaffold were not braced properly and the scaffold's poles were not plumb.  Condition observed on or about 06/13/23.  NOTE:  IN ADDITION TO ABATEMENT CERTIFICATION, THE EMPLOYER IS REQUIRED TO SUBMIT ABATEMENT DOCUMENTATION FOR THIS ITEM, FAILURE TO COMPLY WILL RESULT IN AN ADDITIONAL PENALTY OF $1000.00 IN ACCORDANCE WITH 29 CFR 1903.19.

29 CFR  1926.451(g)(4)(ix): Midrails, screens, mesh, intermediate vertical members, soild panels, and equivalent structural members of a guardrail system were not capable of withstanding, without failure, a force to applied in any downward or horizontal direction at any point along the midrail or other member of at least 75 pounds for guardrail systems with a minimum 100 pound toprail capacity, and at least 150 pounds for guardrail systems with a minimum 200 pound toprail capacity:   a)  Back of Residential Structure, 268 Dutchman's Point Road, Brick Township NJ: Employees assisting with the installation of roof shingles, and other related activities, were exposed to fall hazards when working from a mixed component aluminum pump jack scaffold system whose midrail/screen of the scaffold was not secured to prevent displacement and was not capable of withstanding any force applied.  Condition observed on or about 06/13/23.  NOTE:  IN ADDITION TO ABATEMENT CERTIFICATION, THE EMPLOYER IS REQUIRED TO SUBMIT ABATEMENT DOCUMENTATION FOR THIS ITEM, FAILURE TO COMPLY WILL RESULT IN AN ADDITIONAL PENALTY OF $1000.00 IN ACCORDANCE WITH 29 CFR 1903.19.

29 CFR  1926.452(j)(2): Poles were not secured to the structure by rigid triangular bracing or equivalent at the bottom, top, and other points as necessary:  a)  Back of Residential Structure, 268 Dutchman's Point Road, Brick Township NJ: Employees assisting with the installation of roof shingles, and other related activities, from a mixed component aluminum pump jack scaffold system were exposed to fall hazards when the three poles supporting the scaffold were only secured to the top of the structure with one brace each. Each of those braces was approximately 26 feet above ground level and being such this scaffold required additional bracing at its base.  Condition observed on or about 06/13/23.  NOTE:  IN ADDITION TO ABATEMENT CERTIFICATION, THE EMPLOYER IS REQUIRED TO SUBMIT ABATEMENT DOCUMENTATION FOR THIS ITEM, FAILURE TO COMPLY WILL RESULT IN AN ADDITIONAL PENALTY OF $1000.00 IN ACCORDANCE WITH 29 CFR 1903.19.

29 CFR 1926.452(j)(3): When guardrails are used for fall protection, a workbench was used as the toprail which did not meet all the (guardrail) requirements in paragraphs (g)(4)(ii), (vii), (viii), and (xiii) of 1926.451:     a) Back side of residential structrure, 268 Dutchman's Point Road, Brick Township NJ:  The pump jack scaffold's workbench, consisting of an extended aluminum extension ladder, was not connected to its rest and was unable to withstand, without failure, a horizontal force.  Observed on or about 06/13/23.     NOTE: BECAUSE ABATEMENT OF THIS VIOLATION IS ALREADY DOCUMENTED IN THE CASEFILE, THE EMPLOYER NEED NOT SUBMIT CERTIFICATION NOR DOCUMENTATION OF ABATEMENT OF THIS VIOLATION AS NORMALLY REQUIRED BY 29 CFR 1903.19.
