29 CFR 1926.501(b)(13): Each employee(s) engaged in residential construction activities 6 feet (1.8 m) or more above lower levels were not protected by guardrail systems, safety net system, or personal fall arrest system, nor were employee(s) provided with an alternative fall protection measure under another provision of paragraph 1926.501 (b): (a) Roof; on or about June 12, 2023, and at times prior, the employer exposed employees to fall hazards of approximately 8 feet from the lowest eave to the lower level and approximately 15 feet from the highest eave to the lower level while employees were engaged in roofing activities without the use of guardrail systems, safety net system, or personal fall arrest systems.

29 CFR 1926.1053(b)(1):Where portable ladders were used for access to an upper landing surface and the ladder's length allows, the ladder side rails did not extend at least 3 feet (.9 m) above the upper landing surface being accessed: Nine (9) foot Aluminum (a) Eave of front roof: On or about June 12, 2023 the employer exposed employees to fall hazards of approximately 12 feet, in that a 14 feet aluminum ladder used for accessing the roof extended 1 foot above the upper landing surface where employees were engaged in roofing activities. (b) Eave of front roof: On or about June 12, 2023 the employer exposed employees to fall hazards of approximately 8 feet, in that a 9 feet aluminum ladder used for accessing the roof extended 1 foot above the upper landing surface where employees were engaged in roofing activities.
