29 CFR 1926.451(e)(1): When scaffold platforms were more than 2 feet (0.6 m) above or below a point of access, portable ladders, hook-on ladders, attachable ladders, stair towers (scaffold stairways/towers), stairway-type ladders (such as ladder stands), ramps, walkways, integral prefabricated scaffold access, or direct access from other scaffolds, structure, personnel hoist, or similar surface was not used. Cross braces were used as a means of access. On or about June 14, 2023, employees were performing waterproofing work outside of a building utilizing scaffolding without a means of egress. The cross braces were used as a means of access.

29 CFR 1926.501(b)(1): Each employee on a walking/working surface with an unprotected side or edge which was 6 feet (1.8 m) or more above a lower level was not protected from falling by the use of guardrail systems, safety net systems, or personal fall arrest systems. On or about June 14, 2023, the employees performed siding repair work on an unprotected roof six feet above the lower level without fall protection.
