OSH ACT of 1970 Section 5(a)(1) of the Occupational Safety and Health Act: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees, in that employees were not protected from the hazard of high heat while performing job duties.  a) Facility at 150 Boulder Drive in Breinigsville, PA Oven area - On or about July 27, 2023, and at times prior thereto, employees were exposed to the hazard of high heat produced from industrial baking ovens maintained at up to 400 degrees Fahrenheit during the performance of their job duties needed to maintain the flow of product along the lines including but not limited to walking, monitoring computer controls, shifting baskets, and managing product issues. At the time of inspection, the wet-bulb globe temperature (WBGT) in the oven area was 30.8 degrees Celsius (87.44 degrees Fahrenheit). A heat advisory was in effect on the day of monitoring. Such exposures are likely to lead to the development of serious heat-related illnesses in employees such as, but not limited to, heat stress, heat exhaustion, heat stroke, nausea, and dizziness.  b) Facility at 150 Boulder Drive in Breinigsville, PA Production Line area. On or about July 27, 2023, and at times prior thereto, employees were exposed to the hazard of high heat produced from industrial baking ovens maintained at up to 400 degrees Fahrenheit during the performance of their job duties needed to maintain the flow of product along the lines including but not limited to walking, monitoring computer controls, shifting baskets, and changing labels. At the time of inspection, the WBGT in the production line area was 29.3 degrees Celsius (84.74 degrees Fahrenheit). A heat advisory was in effect on the day of monitoring. Such exposures are likely to lead to the development of serious heat-related illnesses in employees such as, but not limited to, heat stress, heat exhaustion, heat stroke, nausea, and dizziness.
