29 CFR 1926.651(j)(2): Protection was not provided by placing and keeping excavated or other materials or equipment at least 2 feet (.61m) from the edge of excavations, or by the use of retaining devices that were sufficient to prevent materials or equipment from falling or rolling into excavations, or by a combination of both if necessary. (a) On or about June 14, 2023, at 162 Burns Ave, Longwood FL, employees were directed to work in a trench that was approximately 6 feet 7 inches deep, with vertical sides, in class C soil where the spoil pile was not at least 2 feet away from the excavation, exposing employees to crush-by and struck-by hazards.

On or about June 14, 2023, at 162 Burns Ave, Longwood FL, employees working in a trench that was approximately 6 feet 7 inches deep, 4 feet 8 inches wide and 6 feet 8 inches long with vertical sides, in class C soil, were not protected from struck-by and crush-by hazards, in that, case in protection was not provided at the open end.
