29 CFR 1926.20(b)(3): The use of any machinery, tool, material, or equipment which is not in compliance with any applicable requirement of this part is prohibited. Such machine, tool, material, or equipment shall either be identified as unsafe by tagging or locking the controls to render them inoperable or shall be physically removed from its place of operation. On and before June 15, 2023, with respect to a worksite located at 165 Lombardi Ave, Green Bay, WI 54304, employees and subcontractors of Miron Construction Co., Inc. were exposed to pinch-point hazards associated with the operation of an electric dumbwaiter when the employer did not ensure the controls for the lift had been tagged or locked to render the lift inoperable. The electric dumbwaiter had not been adequately guarded, as required in 1926.552.

OSH ACT of 1970 Section (5)(a)(1) The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees. On and before June 15, 2023, with respect to a worksite located at 1265 Lombardi Ave, Green Bay, WI 54304, employees of Miron Construction Co., Inc. were exposed to pinch-point hazards associated with an unenclosed hoistway of an electric dumbwaiter in the South End Zone. Among other feasible and acceptable methods to correct this hazard is to not allow employees to operate a dumb waiter that is not in compliance with the current edition of American National Standards Institute (ANSI) A17.1.

Where manufacturer's specifications are not available, the limitations assigned to the equipment shall be based on the determinations of a professional engineer competent in the field.
