29 CFR 1910.332(b)(1): Employees were not trained in and familiar with the safety-related work practices required by 1910.331 through 1910.335 that pertained to their respective job assignments:  a)  On or about June 15, 2023, the employer did not document that an employee operating a tilt trailer, was trained on hazard recognition and work practices to perform when exposed to electrical shock hazards from overhead powerlines.  In accordance with 29 CFR 1903.19(d), abatement certification is required for this violation (using the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET), and in addition, documentation demonstrating that abatement is complete must be included with your certification.  This documentation may include, but is not limited to, evidence of the purchase or repair of the equipment, photographic or video evidence of abatement, or other written records.

29 CFR 1910.333(c)(3)(iii)(A): A vehicle or mechanical equipment capable of having parts of its structure elevated near energized overhead lines was operated so that a clearance of 10 ft. (305 cm) was not maintained.  a)  On or about June 15, 2023, the employer did not ensure that an employee performing container pickup operating a container trailer tilt complied with the requirement to maintain a clearance of 10 ft. (305 cm) from overhead powerlines when the load on the tilt shifted and caused the tilt to raise within the 10 ft. (305 cm) clearance.   No abatement certification or documentation is required for this item.
