29 CFR  1926.501(b)(13):Each employee(s) engaged in residential construction activities 6 feet (1.8 m) or more above lower levels were not protected by guardrail systems, safety net system, or personal fall arrest system, nor were employee(s) provided with an alternative fall protection measure under another provision of paragraph 1926.501 (b):   a. On or about June 14, 2023, at the above addressed jobsite, an employee performing residential roofing operations, nine (9) feet above ground, was not protected from falls, thereby exposing the employee to fall hazards.  b. On or about June 14, 2023, at the above addressed jobsite, employees performing residential roofing operations, nineteen (19) feet nine (9) inches above ground, were not protected from falls, thereby exposing the employees to fall hazards.

29 CFR  1926.502(d)(17): The attachment point of the body belt shall be located in the center of the wearer's back. The attachment point of the body harness shall be located in the center of the wearer's back near shoulder level, or above the wearer's head.   a. On or about June 14, 2023, at the above addressed jobsite, an employee performing residential roofing operations, nine (9) feet above ground, was not protected from falls, thereby exposing the employee to fall hazards.

29 CFR  1926.503(b)(1):The employer did not verify compliance with paragraph (a) of this section by preparing a written (training) certification record including the name or other identity of the employee trained, the date(s) of the training, and the signature of the person who conducted the training or the signature of the employer.  On or about June 14, 2023, the employer failed to certify that employees had been trained to recognize and minimize fall hazards. Employees were exposed to fall hazards between 9 feet, 5 inches and 16 feet, 8 inches high while performing roofing activities on a residential structure without properly using fall protection.
