Alleged Violation Description OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees, in that employees were exposed to struck-by hazards associated with inadequately maintained racking systems: (a) Jobsite: 9990 Gantry Road, Philadelphia, PA 19115 - On or about June 16, 2023, the employer did not ensure steel racking system used to store pallets with cardboard boxes containing parts was secured with floor and wall anchors, exposing employees to a struck-by hazard when they operated forklifts to load and unload equipment on to the racks and when employees are walking near the racks.

29 CFR 1910.101(b): The in-plant handling, storage, and utilization of all compressed gases in cylinders, portable tanks, rail tankcars, or motor vehicle cargo tanks were not in accordance with Compressed Gas Association Pamphlet P-1-1965, which is incorporated by reference as specified in CFR 1910.6 Section 3.3.1 of the CGA Pamphlet P-1-1965 refers to storing cylinders in accordance with CGA and NFPA standards. The CGA Pamphlet P-1-1991 Section 3.7.4.1 states that "All compressed gas cylinders in service or in storage shall be secured to prevent from falling." (a) Jobsite: 9990 Gantry Road, Philadelphia, PA 19115 - On or about June 16, 2023, the employer did not ensure that the storage of compressed gas cylinders, such as an approximately 8lb cylinder containing Argon, was immobilized by chains or other means to prevent from being knocked over, thereby exposing employees to struck-by hazards.

29 CFR 1910.106(d)(3)(ii)(a): Metal storage cabinets construction. The bottom, top, door, and sides of cabinet were not at least No. 18 gage sheet iron and double walled with 1 1/2 - inch air space. Joints were not riveted, welded or made tight by some equally effective means. The door was not provided with a three-point lock, and the door sill was not raised at least 2 inches above the bottom of the cabinet. (a) Jobsite: 9990 Gantry Road, Philadelphia, PA 19115 - On or about June 16, 2023, the employer did not ensure a metal storage cabinet containing flammable liquids such as, but not limited to acetone, paint thinner, etc. were not constructed with 18 gage sheet iron and double walled with 1 and 1 half inch air space. The metal storage cabinet doors were constructed with perforated sheet metal.

(a) Jobsite: 9990 Gantry Road, Philadelphia, PA 19115 - On or about June 16, 2023: The employer did not ensure that the rotating part of the machine was guarded to prevent employee exposure from such hazard. An employee engaged in polishing metals on the Machine Tool Division MSC 16-50G GAP Bed Lathe in the area of the unguarded chuck was exposed to the rotating parts.
