29 CFR  1903.19(d)(1): The employer must submit to the Agency, along with the information on abatement certification required by paragraph (c)(3) of this section, documents demonstrating that abatement is complete for each willful or repeat violation and for any serious violation for which the Agency indicates in the citation that such abatement documentation is required.  The employer did not provide abatement documentation proving that the hazards related to fall protection training certification were abated for the citations that were issued on September 21, 2023.

29 CFR  1926.100(a):  Employees working in areas where there is a possible danger of head injury from impact, or from falling or flying objects, or from electrical shock and burns, shall be protected by protective helmets:  On June 16, 2023, at a worksite located W5633 County Road KK in Appleton, WI; an employee was not provided with head protection while cleaning up old shingles on the ground level as other employees engaged in residential construction activities, specifically roofing. The employee was exposed to possible head injury from impact as employees working above threw down torn-off shingles and roofing materials from the residential roof.

29 CFR 1926.501(b)(13):  Each employee engaged in residential construction activities 6 feet (1.8 m) or more above lower levels shall be protected by guardrail systems, safety net system, or personal fall arrest system unless another provision in paragraph (b) of this section provides for an alternative fall protection measure. Exception:  When the employer can demonstrate that it is infeasible or creates a greater hazard to use these systems, the employer shall develop and implement a fall protection plan which meets the requirements of paragraph (k) of 1926.502:  On June 16, 2023, at a worksite located W5633 County Road KK in Appleton, WI; employees engaged in residential construction activities, specifically roofing, were working approximately 9.5 feet and greater than 16.5 feet above the lower ground level and were not protected by guardrail systems, safety net systems or personal fall arrest systems.

29 CFR  1926.503(b)(1): The employer shall verify compliance with paragraph (a) of this section by preparing a written certification record. The written certification record shall contain the name or other identity of the employee trained, the date(s) of the training, and the signature of the person who conducted the training or the signature of the employer. If the employer relies on training conducted by another employer or completed prior to the effective date of this section, the certification record shall indicate the date the employer determined the prior training was adequate rather than the date of actual training.   On June 16, 2023, at a worksite located W5633 County Road KK in Appleton, WI; the employer did not verify compliance with providing a training program for each employee exposed to fall hazards, paragraph (a) of this section, through a written certification record when employees engaged in residential construction activities were working approximately 9.5 feet and greater than 16.5 feet above the lower ground level.

29 CFR  1926.502(d)(15)(i):  Anchorages used for attachment of personal fall arrest equipment shall be independent of any anchorage being used to support or suspend platforms and capable of supporting at least 5,000 pounds (22.2 kN) per employee attached, or shall be designed, installed, and used as part of a complete personal fall arrest system which maintains a safety factor of at least two:  On June 16, 2023, at a worksite located W5633 County Road KK in Appleton, WI; anchors used for attachment of personal fall arrest equipment were not installed and used so to maintain a safety factor of two (2). Temporary anchors were only partially nailed into the wood roof and were not flush with the peak of the roof. Lanyards wrapped around rafters and clipped back onto themselves were not attached to designed anchor points.

29 CFR  1926.502(d)(17):  The attachment point of the body belt shall be located in the center of the wearer's back. The attachment point of the body harness shall be located in the center of the wearer's back near shoulder level, or above the wearer's head:   On June 16, 2023, at a worksite located W5633 County Road KK in Appleton, WI; employees fall harnesses were not attached to lanyards in the center of the wearer's back. Two employees had their body harnesses connected to their respective lanyards at their waists.
