29 CFR 1926.20(b)(2): The employer did not initiate and maintain a safety program which provides for frequent and regular inspections of jobsites, materials, and equipment to be made by a competent person who is capable of identifying existing and predictable hazards in the surroundings or working conditions which are unsanitary, hazardous, or dangerous to employees, and who has the authority to take prompt corrective measures to eliminate them:  (a)A & M Construction, LLC at 308 East 2nd Street, Redfield, SD 57469: On or about and at times prior to June 20, 2023, the employer did not ensure an accident prevention program was developed and implemented for the work environment to include regular inspections of the job-site, materials, and equipment; conducted by a competent person. Employees were conducting roofing operations on a single-family residential roof without the use of a fall protection system or adequate training.  This condition exposed employees to fall hazards of greater than six feet.

29 CFR 1926.501(b)(13): Employees engaged in residential construction activities 6 feet (1.8 m) or more above lower levels were not protected by guardrail systems, safety net system, or personal fall arrest system nor were employees provided with an alternative fall protection measure under another provision of paragraph 1926.501(b):  (a)A & M Construction, LLC at 308 East 2nd Street, Redfield, SD 57469: On or about and at times prior to June 20, 2023, the exposing employer did not ensure that employees were protected from falls while conducting roofing operations on a single-family residential roof. This condition exposed employees to fall hazards greater than six feet.

This condition exposed employees to fall hazards greater than six feet.
