The employer must provide, and ensure each employee uses, a safe means of access and egress to and from walking-working surfaces. a) On or before 6/21/2023 the employer did not provide employees working in the shipping department had a safe means of transitioning from the Tri Arc mobile platform ladder onto the walking working surface of the shipping box storage area in that employees exposed to a 12' fall due to an 8' gap when climbing over the railing of the platform ladder on the storage area and back onto the ladder.

29 CFR 1910.28(b)(15): Walking-working surfaces not otherwise addressed. Except as provided elsewhere in this section or by other subparts of 29 CFR part 1910, the employer must ensure each employee on a walking-working surface 4 feet (1.2 m) or more above a lower level is protected from falling by: (i) Guardrail systems; (ii) Safety net systems; or (iii) Personal fall protection systems, such as personal fall arrest, travel restraint, or positioning systems. a) On or about 6/21/2023 the employer did not ensure employees working on the storage platform in the shipping area were protected from a fall hazard of approx. 12 ft. in that the inadequate guard rails left employees exposed to a fall hazard due to an 8 ft. gap in the railing.

29 CFR 1910.212(a)(1): Types of guarding. One or more methods of machine guarding shall be provided to protect the operator and other employees in the machine area from hazards such as those created by point of operation, ingoing nip points, rotating parts, flying chips and sparks. Examples of guarding methods are-barrier guards, two-hand tripping devices,electronic safety devices, etc. a) On or before 6/21/2023 the employer did not ensure that the point of operation for machine such as, but not limited to; the Gear Shapers Fellow (#3) and (#7) were properly guarded in that the cutting area was open allowing employees to reach into the cutting/forming area while in production.

29 CFR 1910.219(f)(1): Gears. Gears shall be guarded in accordance with one of the following methods: (i) By a complete enclosure; or (ii) By a standard guard as described in paragraph (o) of this section, at least seven (7) feet high extending six (6) inches above the mesh point of the gears; or (iii) By a band guard covering the face of gear and having flanges extended inward beyond the root of the teeth on the exposed side or sides. Where any portion of the train of gears guarded by a band guard is less than six (6) feet from the floor a disk guard or a complete enclosure to the height of six (6) feet shall be required. a) On or before 6/21/2023 the employer did not ensure that rotating gears for machine such as, but not limited to; the Gear Shaper Fellows (#3) and (#7) were guarded in that employees were exposed to a caught in hazard while operating the shapers during production.

29 CFR 1910.242(b):Compressed air used for cleaning. Compressed air shall not be used for cleaning purposes except where reduced to less than 30 p.s.i. and then only with effective chip guarding and personal protective equipment. a) On or before 6/21/2023 the employer did not properly reduce the PSI for the compressed air utilized by employees for the cleaning of themselves or equipment exposing employees to hazards associated with compressed air measured at greater than 30 PS1. Test locations as follows: Test location #1 was at the Fellows #3, measured at 46 PSI. Test location #2 was at the Fellows #7, measured at 85 PSI.
