1910.147(c)(2)(i)  If an energy isolating device is not capable of being locked out, the employer's energy control program under paragraph (c)(1) of this section shall utilize a tagout system. 29 CFR  1910.147(c)(1):The employer did not establish a program consisting of an energy control procedure, employee training and periodic inspections to ensure that before any employee performed any servicing or maintenance on a machine or equipment where the unexpected energizing, startup or release of stored energy could occur and cause injury, the machine or equipment shall be isolated from the energy source and rendered inoperative:  a) 80 South Kishacoqillas Street, Belleville, PA, Main Shop - Employees performed servicing and maintenance activities on such equipment as, but not limited to, various concrete pumping trucks and telescopic belt conveyors vehicles without the employer developing and implementing an energy control program, consisting of machine-specific energy control procedures, employee training,  and periodic audits exposing employees  caught-in and struck-by hazards, on or about June 20, 2023.  Abatement certification and documentation required within 10 days after abatement date. The certification shall include a statement that abatement is complete, the date and method of abatement, and state that employees and their representatives were informed of this abatement. Abatement documentation shall include documents demonstrating that abatement is complete, such as evidence of the purchase or repair of equipment, photographic or video evidence of abatement or other written records.
