29 CFR  1926.102(a): The employer did not ensure that each affected employee used appropriate eye or face protection when exposed to eye or face hazards from flying particles.  On or about June 21, 2023 the employer John Miller Construction, at worksite located at 127 S. Jefferson St. Delphos OH 45833, did not ensure that each affected employee used appropriate eye or face protection when performing framing and sheeting work on an existing commercial structure while exposed to potential struck by hazards (flying particles/debris) while using a Milwaukee brand Tilt Lock electrical circular saw (S/N 983FD203800902).

29 CFR  1926.501(b)(1): Each employee on a walking/working surface with an unprotected side or edge which was 6 feet (1.8 m) or more above a lower level was not protected from falling by the use of guardrail systems, safety net systems, or personal fall arrest systems.  On or about June 21, 2023 the employer John Miller Construction, at worksite located at 127 S. Jefferson St., Delphos, OH 45833, did not ensure employees were protected from falls while conducting commercial wood framing construction activities on the second (roof) level of a commercial building, while exposed to a fall of approximately 18 feet or greater to the ground below. Employees were working atop a steep roof with an 8:12 pitch at the peak of the roof.
