29 CFR  1926.21(b)(2):The employer shall instruct each employee in the recognition and avoidance of unsafe conditions and the regulations applicable to his work environment to control or eliminate any hazards or other exposure to illness or injury.  On or about June 21, 2023 at location 5140 W Integrity Way, Appleton, Wisconsin: the employer did not instruct a Foreman employee in the recognition and avoidance of situations that could result in possible cave ins, indications of failure of protective systems, or other hazardous conditions and the regulations applicable to their work environment to control or eliminate any hazards or other exposures to injury when employees installed sewer system components in an trench.

29 CFR  1926.651(k)(1):Daily inspections of excavations, the adjacent areas, and protective systems shall be made by a competent person for evidence of a situation that could result in possible cave-ins, indications of failure of protective systems, hazardous atmospheres, or other hazardous conditions. An inspection shall be conducted by the competent person prior to the start of work and as needed throughout the shift. Inspections shall also be made after every rainstorm or other hazard increasing occurrence. These inspections are only required when employee exposure can be reasonably anticipated.  On or about June 21, 2023 at location 5140 W Integrity Way, Appleton, Wisconsin: the employer did not ensure daily inspection of excavations, adjacent areas, and protective systems, for evidence of situations that could result in cave cave-in, indications of failure of protective systems, hazardous atmospheres, or other hazardous conditions, were made by a competent person. The employer did not ensure those inspections were conducted when employees were exposed to hazards while accessing and working in the site's excavation.

29 CFR  1926.652(a)(1):Each employee in an excavation shall be protected from cave-ins by an adequate protective system designed in accordance with paragraph (b) or (c) of this section except when:  On or about June 21, 2023 at location 5140 W Integrity Way, Appleton, Wisconsin: the employer did not ensure each employee in the trench excavation was protected from cave-in by an adequate protective system.  The trench was not sloped or benched to the required 18 inches level below the top of the trench shield, and the trench was deeper than the rated depth of the trench shield.

29 CFR  1926.652(b)(3)(iii):At least one copy of the tabulated data which identifies the registered professional engineer who approved the data, shall be maintained at the jobsite during construction of the protective system. After that time the data may be stored off the jobsite, but a copy of the data shall be made available to the Secretary upon request.  On or about June 21, 2023 at location 5140 W Integrity Way, Appleton, Wisconsin: the tabulated data for a Trench shield (Model: PAL3-88SKE, Serial: 40038) used for cave-in protection for employees working in a trench was not available at the worksite

29 CFR  1926.652(g)(2): Additional requirement for shield systems used in trench excavations. Excavations of earth material to a level not greater than 2 feet (.61 m) below the bottom of a shield shall be permitted, but only if the shield is designed to resist the forces calculated for the full depth of the trench, and there are no indications while the trench is open of a possible loss of soil from behind or below the bottom of the shield.   On or about June 21, 2023 at location 5140 W Integrity Way, Appleton, Wisconsin: employees were exposed to cave-in hazards while working where the excavation of material was greater than two feet below the bottom of the Trench shield (Model: PAL3-88SKE, Serial: 40038).
