29 CFR 1910.95(c)(1): The employer did not administer a continuing, effective hearing conservation program as described in 29 CFR 1910.95(c) through (o) whenever employee noise exposures equal or exceed an 8-hour time-weighted average sound level of 85 decibels measured on the A scale, or equivalently a dose of fifty percent: a) On or about July 11, 2023, and at times prior, in the production floor, where an operator was exposed to continuous noise at a dose of 81% of the allowable time-weighted average (TWA) during the 11.1-hour sampling period. The equivalent dBA level of 81% is approximately 88.4 dBA. The action level was adjusted to 82.6 dBA for an extended shift of 11.1 hours. b) On or about July 11, 2023, and at times prior, in the production floor, where an operator was exposed to continuous noise at a dose of 68% of the allowable time-weighted average (TWA) during the 8-hour sampling period. The equivalent dBA level of 68% is approximately 87.2 dBA. Exposure calculations assume zero exposure for the 29 minutes not sampled. c) On or about July 11, 2023, and at times prior, in the production floor, where a recycle area worker was exposed to continuous noise at a dose of 226% of the allowable time-weighted average (TWA) during the 10.5-hour sampling period. The equivalent dBA level of 226% is approximately 95.8 dBA. The action level was adjusted to 83 dBA for an extended shift of 10.5 hours. d) On or about July 11, 2023, and at times prior, in the production floor, where an operator was exposed to continuous noise at a dose of 157% of the allowable time-weighted average (TWA) during the 10.6-hour sampling period. The equivalent dBA level of 157% is approximately 93.2 dBA. The action level was adjusted to 83 dBA for an extended shift of 10.6 hours. e) On or about July 11, 2023, and at times prior, in the production floor, where an operator was exposed to continuous noise at a dose of 126% of the allowable time-weighted average (TWA) during the 11-hour sampling period. The equivalent dBA level of 126% is approximately 91.6 dBA. The action level was adjusted to 83 dBA for an extended shift of 11 hours.
