29 CFR  1926.501(b)(1): Each employee on a walking/working surface having an unprotected side or edge which was six or more feet (1.8m) or more above a lower level was not protected from falling by the use of guardrail systems, safety net systems, or personal fall arrest systems:  a) At 7954 Jacks Way, Horace, ND 58047. Building #2, on or at times prior to June 20, 2023, the employer did not ensure employees were accessing a ladder positioned on a landing with an unprotected side or edge without an adequate fall protection system in place.

29 CFR  1926.501(b)(4)(i): Each employee on walking/working surfaces was not protected from falling through holes (including skylights), more than six feet (1.8 m) above lower levels, by personal fall arrest systems, covers, or guardrail systems erected around such holes:  a) At 7954 Jacks Way, Horace, ND 58047. Building #2, on or at times prior to June 20, 2023, while accessing the roof through a hatch, and working in close proximity to the opening, employees were exposed to falling through the hatch which was left open and unsecured.

Or, on roofs 50-feet (15.25 m) or less in width, each employee was not protected by use of a monitoring system.  a) At 7954 Jacks Way, Horace, ND 58047.  Building #2. On or at times prior to June 20, 2023, the employees engaged in roofing operations on the 4:12 pitch roof of a commercial building were exposed to fall hazards of greater than 20 feet.

29 CFR  1926.1053(b)(1): Where (a) portable ladder(s) was/were used for access to an upper-level landing surface and the ladder's length did not allow the ladder side rails to extend at least 3 feet (0.9 m) above the upper landing surface being accessed, the ladder was not secured at its top to a rigid support that will not deflect, and/or a grasping device was not provided to assist employees in mounting and dismounting the ladder.    a) At 7954 Jacks Way, Horace, ND 58047, Building #2, on or at times prior to June 20, 2023, the employer did not ensure the Little Giant extension ladder used to access from the first floor to the second first floor extended at least three feet above the upper landing surface.
