29 CFR  1926.20(b)(2): The employer did not initiate and maintain a safety program which provides for frequent and regular inspections of jobsites, materials, and equipment to be made by a competent person who is capable of identifying existing and predictable hazards in the surroundings or working conditions which are unsanitary, hazardous, or dangerous to employees, and who has the authority to take prompt corrective measures to eliminate them:  (a)SoDak Construction, LLC at 120 North Heritage Parkway, Tea, SD, SD 57064: On or about and at times prior to June 22, 2023, the employer did not ensure an accident prevention program was developed and implemented for the work environment to include regular inspections of the job-site, materials, and equipment; conducted by a competent person.  Employees and subcontracted employees were conducting roofing and framing operations on a multi-use residential property without the use of a fall protection systems in place, a lack of training, and operating telehandlers without certification.  This condition exposed employees and subcontracted employees to various hazards on site.

29 CFR  1910.178(l)(1)(i): The employer did not ensure that each powered industrial truck operator was competent to operate a powered industrial truck safely, as demonstrated by the successful completion of the training and evaluation specified in this paragraph (l):  (a)SoDak Construction, LLC at 120 North Heritage Parkway, Tea, SD, 57064: On or about and at times prior to June 22, 2023, the exposing employer did not ensure that an employee operating the Ingersoll-Rand VR-642C All-Terrain Telescopic Material Handler was competent to operate by ensuring the operator completed operator training, evaluation, and certification prior to use.  This condition exposed employees to struck-by hazards.

29 CFR  1926.451(c)(2)(iv): Front-end loaders and similar pieces of equipment were used to support scaffold platforms when they were not specifically designed by the manufacturer for such use:   (a)SoDak Construction, LLC at 120 North Heritage Parkway, Tea, SD 57064:  On or about and at times prior to June 22, 2023, the exposing employer did not  ensure employees were protected from serious injury while using an elevated work platform which was not designed, constructed, or used in accordance with the requirements of the rough terrain forklift manufacturer. Employees utilized the platform to conduct framing operations on a multi-use residential property under construction. The platform was not specifically approved by the forklift manufacturer nor did it meet ASME/ITSDF B56.6-2011 requirements. The platform exceeded criteria for the overall length and did not have a data plate identifying maximum working load including personnel and equipment. This condition exposed employees to fall hazards and crushing hazards related to the platform separating from the mast.

29 CFR  1926.451(g)(1): Employees on scaffolds more than 10 feet (3.1 m) above a lower level were not protected from falling to that lower level by fall protection established in paragraphs (g)(1)(i)-(vii) of this section:  (a)SoDak Construction, LLC at 120 North Heritage Parkway, Tea, SD, SD 57064: On or about and at times prior to June 22, 2023, the exposing employer did not ensure that employees were protected from falls in that employees working within the basket on the telehandler, due to employees  standing and working from the mid rail of the basket.  This condition exposed employees to fall hazards greater than 10 feet.

This condition exposed subcontracted employees to fall hazards greater than six feet.
