29 CFR 1910.212(a)(1): One or more methods of machine guarding was not provided to protect the operator and other employees in the machine area from hazards such as those created by point of operation, ingoing nip points, rotating parts, flying chips and sparks: On or about June 23, 2023, and times prior thereto, employees operating the Bobst Infeed Conveyor and Depalletizer system were exposed to nip point hazards from the automatic cycling of the unguarded Systec pallet sweep equipment.

Standard 1910.261(a)(3)(v) incorporates by reference ANSI B20.1-1957: Safety Code for Conveyors, Cableways, and Related Equipment. On or about June 23, 2023, at the Smurfit Kappa Plant located at 6433 Davis Blvd., North Richland Hills, TX 76182, no emergency stop switch was provided at the operator console of the Smurfit Kappa Systec Pallet Sweep Operating Station inside the Smurfit Kappa plant, as required by the ANSI B20.1-1957: Safety Code for Conveyors, Cableways, and Related Equipment, under Section 11, paragraph b on pp. 29. This exposed workers to crush-by hazards.
