29 CFR 1926.1051(a): Stairways or ladders were not provided at all personnel points of access where there was a break in elevation of 19 inches (48 cm) or more, and no ramp, runway, sloped embankment, or personnel hoist was provided: On or about June 24, 2023, employees on the Scott Credit Union building were not provided a ladder at the elevation change between the main building roof and drive-through roof. The break in elevation was greater than 19 inches.

29 CFR 1926.1053(b)(1): Portable ladders are used for access to an upper landing surface and the ladder side rails do not extend at least 3 feet (.9 m) above the upper landing surface to which the ladder is used to gain access: On or about June 24, 2023, the employer did not ensure the portable ladder for accessing the drive-through roof was placed so three (3) feet or more was extended above the upper landing. Workers were exposed to falling approximately ten (10) feet while using the extension ladder to ascend/descend from the ground level to the roof.
