29 CFR 1926.501(b)(10):Each employee engaged in roofing activities on low-slope roofs with unprotected sides and edges 6 feet or more above lower levels, was not protected from falling by guardrail systems, safety net systems, personal fall arrest systems, or a combination of warning line system and guardrail system, warning line system and safety net system, or warning line system and personal fall arrest system, or warning line system and safety monitoring system. Or, on roofs 50-feet (15.25 m) or less in width, each employee was not protected by use of a monitoring system: (a) Jobsite: On or about June 26, 2023, employees were working on a low sloped roof and they were not protected from falling approximately 18 feet to the asphalt parking lot, nor was a monitoring system in use.

29 CFR 1926.503(c): The employer did not retrain affected employees who already had been trained but demonstrated inadequate understanding and skill required by paragraph (a) of this section: a) Jobsite: On or about June 26, 2023, the employer needs to retrain its employees in how and when to use fall protection. Employees were working on a flat roof and they were not using any fall protection.
