OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees, in that employees were exposed to potential crushing hazards from falling loads and/or lift parts: a) Bay 1 (closest to lobby area), Florida Fine Cars & Trucks, LLC, 28603 State Route 3, Black River, NY 13612, on or about 6/27/2023, a two-post surface mounted Dannmar, Lift Model Number D-10ACX, Serial Number 2280, was operated without being inspected and certified since installation approximately 5 years ago. b) Bay 2 (middle bay), Florida Fine Cars & Trucks, LLC, 28603 State Route 3, Black River, NY 13612, on or about 6/27/2023, a two-post surface mounted lift manufactured in China, was operated without being inspected and certified since installation approximately 5 years ago. Lift did not have any comprehendible labels or capacity ratings posted.
