29 CFR  1910.147(c)(1): The employer did not establish a program consisting of an energy control procedure, employee training and periodic inspections to ensure that before any employee performed any servicing or maintenance on a machine or equipment where the unexpected energizing, startup or release of stored energy could occur and cause injury, the machine or equipment shall be isolated from the energy source and rendered inoperative:   a) On or about 06/27/2023, throughout the establishment; an energy control program was not established that consists of specific energy control procedures, authorized employee training and periodic inspections to ensure employees perform energy control procedures before servicing or doing maintenance such as, but not limited to, changing dies/making repairs on mechanical power presses #2 Johnson 100 ton, #3 Niagara 90 ton, and #5 Minster 22 ton, and press brakes #16 Durma, and changing blade on #22 bandsaw.  ABATEMENT CERTIFICATION REQUIRED

29 CFR  1904.41(a)(2):29 CFR 1904.41(a)(2) Annual electronic submission of OSHA Form 300A Summary of Work-Related Injuries and Illnesses by establishments with 20 or more employees but fewer than 250 employees in designated industries. If your establishment had 20 or more employees but fewer than 250 employees at any time during the previous calendar year, and your establishment is classified in an industry listed in appendix A to subpart E of this part, then you must electronically submit information from OSHA Form 300A Summary of Work-Related Injuries and Illnesses to OSHA or OSHA's designee. You must submit the information once a year, no later than the date listed in paragraph (c) of this section of the year after the calendar year covered by the form.  a) On or about 06/27/2023 at Dunkirk Metal Products of WNY; the employer failed during calendar year 2023, to electronically submit information from their 2022 OSHA Form 300A or equivalent by 03/02/2023. The establishment employed 32 employees and was classified under NAICS industry code 332119 during calendar year 2022.  NO ABATEMENT CERTIFICATION REQUIRED
