29 CFR 1926.20(b)(2): The employer did not initiate and maintain a safety program which provides for frequent and regular inspections of jobsites, materials, and equipment to be made by a competent person who is capable of identifying existing and predictable hazards in the surroundings or working conditions which are unsanitary, hazardous, or dangerous to employees, and who has the authority to take prompt corrective measures to eliminate them:  (a)Wegner Roofing & Solar Corporation at 901 West Russell Street, Sioux Falls, SD 57104: On or about and at times prior to June 27, 2023, the controlling employer did not ensure an accident prevention program was developed and implemented for the work environment to include regular inspections of the job-site, materials, and equipment; conducted by a competent person.  Subcontracted employees were exposed to fall hazards as a result of conducting commercial roofing activities without the use of a fall protection system and fall hazards associated with improper use of ladders. This condition exposed subcontracted employees to a variety of hazards identified on site.

This condition exposed the subcontracted employees to fall hazards greater than six feet.

29 CFR  1926.1053(b)(1):Where portable ladders were used for access to an upper landing surface and the ladder's length allows, the ladder side rails did not extend at least 3 feet (.9 m) above the upper landing surface being accessed:  (a)Wegner Roofing & Solar Corporation at 901 West Russell Street, Sioux Falls, SD 57104: On or about and at times prior to June 27, 2023, the controlling employer did not ensure that the ladder the subcontracted employees were using was extended at least three feet above the upper landing surface of the west edge of a commercial building roof.  This condition exposed subcontracted employees to fall hazards greater than six feet.
