29 CFR 1910.147(c)(6)(i):The employer did not conduct a periodic inspection of the energy control procedure at least annually to ensure that the procedure and the requirement of this standard were being followed: a) At Hydro: On or about June 27, 2023 and at times prior, the employer exposed employees to the release of uncontrolled chemical energy sources, in that the employer did not inspect the energy control procedures at least annually on 25% Caustic Tank ANA-TK-06 while employees were tasked with providing service and maintenance to the equipment.

29 CFR 1910.147(c)(4)(ii):Procedures did not clearly and specifically outline the scope, purpose, authorization, rules, and techniques to be utilized for the control of hazardous energy, and the means to enforce compliance including, but not limited to, 29 CFR 1910.147(c)(4)(ii)(A), (c)(4)(ii)(B), (c)(4)(ii)(C) and (c)(4)(ii)(D): a) At Hydro: On or about June 26 2023 and at times prior, the employer exposed employees to the release of uncontrolled chemical hazards, in that the hazardous energy control procedures did not specifically outline the scope, purpose, authorization, rules, techniques and the means to enforce compliance, to be utilized for the control of hazardous energy while authorized maintenance technicians were inspecting the equipment. a) At Hydro: On or about June 26 2023 and at times prior, the employer exposed employees to the release of uncontrolled chemical hazards, in that the hazardous energy control procedure checklist provided by the employer, for the 25% Caustic Tank, ANA-TK-06 , did not specifically outline the intended use of the procedure, the specific steps for isolating or controlling hazardous energy, the specific steps for placement, removal, transfer of the locks, and the specific requirements for testing a machine or equipment to verify the effectiveness of the energy control measures while authorized maintenance technicians were inspecting the equipment.
