29 CFR 1960.8(a): The Agency head did not furnish employment and a place of employment to each employee that were free from recognized hazards that caused or were likely to cause death or serious physical harm: STATE ROUTE 80 CHECKPOINT: The Border Patrol failed to ensure the temporary traffic barriers were crashworthy, exposing employees to struck-by hazards from motor vehicles. On June 27, 2023, a Border Patrol Agent was hospitalized after the guard shack was struck by a motor vehicle. OSHA previously issued a Notice to the U.S. Border Patrol for a violation of this occupational safety and health standard in inspection #1641253, Notice #1, Item #3, with respect to the State Route 80 checkpoint, which became a final order on June 26, 2023.
