29 CFR 1926.1153(c)(1): For each employee engaged in a task identified in Table 1, the employer did not fully and properly implement the engineering controls, work practices, and respiratory protection specified for the task in Table 1, unless the employer assesses and limits the exposure of the employee to respirable crystalline silica in accordance with paragraph (d) of this section. At a construction site located at 27200 E Cedar Grove Street in Lake Lotawana, Missouri 64086, on or about June 26, 2023: Employees were exposed to respiratory hazards when dry-cutting concrete stones containing crystalline silica. Workers were observed doing masonry-type work on the steps just outside of the pool building. The employees were cutting the stones for a period of 4-6 hours per shift, outside, using a handheld saw that did not implement the required engineering controls.

29 CFR 1926.1153(i)(1): The employer did not include respirable crystalline silica in the program established to comply with the hazard communication standard (HCS) (29 CFR 1910.1200): At a construction site located at 27200 E Cedar Grove Street in Lake Lotawana, Missouri 64086, on or about June 26, 2023: Employees were exposed to respiratory hazards when dry-cutting concrete stones containing crystalline silica. Workers were observed doing masonry-type work on the steps just outside of the pool building. The employees were not trained or made aware of the respiratory hazards associated with dry-cutting concrete stones. The employer did not include hazards associated with respirable crystalline silica dust in their hazard communication training and as part of their written program.
