29 CFR 1926.21(b)(2): The employer did not instruct each employee in the recognition and avoidance of unsafe conditions and the regulations applicable to his/her environment to control or eliminate any hazards or other exposure to illness or injury: a) For the jobsite 7146 Kenwood Dr., North Port, FL 34287, on or about 06/26/2023, the employer exposed employees to high ambient heat from direct sunlight while installing gutters and down spouts in that, employees were not trained on the hazards of heat stress/illness awareness and what to do in event of heat illness. The calculated Wet Bulb Globe Temperature (WBGT) ranged from 84� F - 93� F (29� C - 34� C) while working outdoors performing moderate manual labor and wearing long sleeves and pants.

29 CFR 1926.403(b)(1)(iii): Safety of equipment was not determined on the basis of electrical insulation. a) For the power cord on the aluminum gutter machine at the jobsite 7146 Kenwood Dr., North Port, FL 34287, on or about 06/26/2023, the employer exposed employees to electrical shock hazards, in that, the outer insulation of a flexible power cord had been pulled away at the cord's plug, and there was a cut in the inner wire's insulation that could expose internal 110VAC conductors. b) For the power cord on the aluminum gutter machine at the jobsite 1105 Moss Cove Ct., Port Charlotte, FL 33953, on or about 06/26/2023, the employer exposed employees to electrical shock hazards, in that, the outer insulation of a flexible power cord had been pulled away at the cord's plug, and there was a cut in the inner wire's insulation that could expose internal 110VAC conductors.
