OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment that were free from recognized hazards and were causing or likely to cause death or serious physical harm to employees. Employees were exposed to impact and crushing hazards when the employer allowed employees to use a modified hydraulic elevating cart to move and handle machine parts: a) Coater #11 -On or about June 29, 2023, the employer utilizes a Dayton field modified hydraulic elevating cart for employees to remove the "Pearl Fountain Head" from inside the machine. The positioning and the placement of the part on the modified cart has changed its stability and causes the cart to lift off the ground. Employees are exposed to crushing and caught between hazards from the cart tipping with the part load. Among other methods, feasible means of abatement methods to correct this hazard are to follow the Dayton operating instructions for the cart and Dayton approval for modifications to the cart.
