LOCATION: the jobsite at 19 Newport Ave. On or about June 29th, 2023 an Employee of Sean Farrell Excavation was exposed to caught between, crush, and struck-by injuries when operating the mini-excavator he was in without the use of the seatbelts provided by the manufacturer.

LOCATION: The Jobsite located at On or about June 29th, 2023 the employees of Sean Farrell Excavation were exposed to excavation hazards when a ladder was not available for employees working in a trench over 4 feet deep.

29 CFR 1926.651(k)(1): An inspection of the excavations, the adjacent areas, and protective systems was not conducted by the competent person prior to the start of work and as needed throughout the shift. LOCATION: The Jobsite located at 19 Newport Ave. On or about June 29th, 2023, the employees of Sean Farrell Excavation were allowed to be exposed to cave-in hazards while working in a trench without cave-in protection when the workers were at a depth greater than 5 five (5) feet, a ladder or other egress was not readily available, and the spall pile was immediately adjacent to the trench the worker was in. This condition would have been prevented by an inspection done by the competent person on site.
