Located at the job site located at 1100 Mediterranean Avenue, Columbus, Ohio: On or about June 28, 2023, and at times prior, the employer did not ensure that an effective safety and health program was initiated and maintained onsite to ensure that hazards such as, but not limited to, operating power tools exposed to struck-by hazards and working at heights exposed to fall hazards were identified and corrected while employees performed hotel remodeling and roofing work onsite.

Except as otherwise provided in paragraph (b) of this section, each employee engaged in roofing activities on low-slope roofs, with unprotected sides and edges 6 feet (1.8 m) or more above lower levels shall be protected from falling by guardrail systems, safety net systems, personal fall arrest systems, or a combination of warning line system and guardrail system, warning line system and safety net system, or warning line system and personal fall arrest system, or warning line system and safety monitoring system. Or, on roofs 50-feet (15.25 m) or less in width (see Appendix A to subpart M of this part), the use of a safety monitoring system alone [i.e. without the warning line system] is permitted.  a. Located at the job site located at 1100 Mediterranean Avenue, Columbus, Ohio: On or about June 28, 2023, and at times prior, employees worked from the flat roof at or near the unprotected edges to perform roofing demolition work on the existing roof structure without fall protection or prevention measures in use. 29 CFR 1926.852(b): All materials chutes, or sections thereof, at an angle of more than 45 deg. from the horizontal, shall be entirely enclosed, except for openings equipped with closures at or about floor level for the insertion of materials. The openings shall not exceed 48 inches in height measured along the wall of the chute. At all stories below the top floor, such openings shall be kept closed when not in use.  a. Located at the job site located at 1100 Mediterranean Avenue, Columbus, Ohio: On or about June 28, 2023, and at times prior, the employer did not ensure that a materials chute in use from 24-27 feet above the lower level was enclosed and that the chute opening was kept closed when not actively in use. Employees were thereby exposed to struck-by and fall hazards of approximately 24-27 feet.
