29 CFR 1926.102(a)(1): The employer shall ensure that each affected employee uses appropriate eye or face protection when exposed to eye or face hazards from flying particles, molten metal, liquid chemicals, acids or caustic liquids, chemical gases or vapors, or potentially injurious light radiation.  a. Located at the job site at 5221-5235 Bluestem Lane - Building P, Groveport, Ohio 43125: On or about June 28, 2023, an employee operated a pneumatic nail gun to install sheathing to the roof trusses of a new build construction building without utilizing eye protection. The employee was thereby exposed to struck-by hazards while performing this work.

29 CFR 1926.502(d)(16): Personal fall arrest systems, when stopping a fall, shall:  29 CFR 1926.502(d)(16)(iii): be rigged such that an employee can neither free fall more than 6 feet (1.8 m), nor contact any lower level;  a. Located at 5221-5235 Bluestem Lane - Building P, Groveport, Ohio 43125: On or about June 28, 2023, an employee was working from the roof trusses to install sheathing with a full-body harness and horizontal rope lifeline in use. The horizonal rope lifeline was not rigged and adjusted to prevent a free fall of more than 6 feet and/or contact with the lower level, thereby exposing the employee to a fall hazard of approximately eight-nine feet.

29 CFR 1926.503(a)(2): The employer shall assure that each employee has been trained, as necessary, by a competent person qualified in the following areas:  29 CFR 1926.503(a)(2)(iii): The use and operation of guardrail systems, personal fall arrest systems, safety net systems, warning line systems, safety monitoring systems, controlled access zones, and other protection to be used;  a. Located at 5221-5235 Bluestem Lane - Building P, Groveport, Ohio 43125: The employer did not ensure that employees were trained on the proper use and operation of the personal fall arrest systems in use in that they were not trained on how to adjust the rope grab and lifeline as well as how to properly install and use the full-body harness. Employees improperly utilized full-body harnesses and horizontal rope lifelines while sheathing the roof trusses of a new-build apartment building and were thereby exposed to a fall hazard of approximately eight-nine feet.

29 CFR 1926.1053(b)(1): When portable ladders are used for access to an upper landing surface, the ladder side rails shall extend at least 3 feet (.9 m) above the upper landing surface to which the ladder is used to gain access; or, when such an extension is not possible because of the ladder's length, then the ladder shall be secured at its top to a rigid support that will not deflect, and a grasping device, such as a grabrail, shall be provided to assist employees in mounting and dismounting the ladder. In no case shall the extension be such that ladder deflection under a load would, by itself, cause the ladder to slip off its support.  a. Located at 5221-5235 Bluestem Lane - Building P - Groveport, Ohio 43125: On or about June 28, 2023, the portable A-frame ladders in use to access and egress the roof were not secured at their tops to a rigid support and a grasping device, such as a grabrail, was not provided. Employees were thereby exposed to a fall hazard of approximately six-eight feet.

Located at 5221-5235 Bluestem Lane - Building P - Groveport, Ohio 43125: On or about June 28, 2023, employees utilized the top step of the portable A-frame ladders in use to access and egress the roof trusses. As a result, employees were exposed to fall hazards of approximately six-eight feet.
