29 CFR 1926.451(c)(2)(v): The employer used forklifts to support scaffold platforms without ensuring that the entire platform was attached to the fork and that the forklift was not moved horizontally while the platform was occupied: (a) Jobsite at 24 Willow Lane in Portsmouth: On or about June 12, 2023, the employer used a forklift to support a scaffold platform, such as sheets of plywood, without ensuring that the entire platform was attached to the forks of a JLG telehandler, model 1055, and thereby exposed employees to fall hazards of approximately 12 -15 feet.

29 CFR 1926.451(g)(1)(vii): Each employee on a scaffold, not otherwise specified in paragraphs (g)(1)(i) through (g)(1)(vi) of this section, more than 10 feet (3.1 m) above lower level was not protected from falls by the use of personal fall arrest systems or guardrail systems meeting the requirements of paragraph (g)(4) of this section. (a) Jobsite at 24 Willow Lane in Portsmouth: On or about June 12, 2023, the employer did not ensure that each employee standing on sheets of plywood on the forks of a JLG telehandler, model 1055, at approximately 12 feet above the lower level (not including the trench depth), was protected from falls by the use of personal fall arrest systems or guardrail systems.
