29 CFR 1926.501(b)(13): Each employee(s) engaged in residential construction activities 6 feet (1.8 m) or more above lower levels were not protected by guardrail systems, safety net system, or personal fall arrest system, nor were employee(s) provided with an alternative fall protection measure under another provision of paragraph 1926.501(b): On or about June 9, 2023, at the above addressed jobsite, employees were performing roofing operations approximately 9.4-18.7 feet above ground and employees were not using fall protection, thereby exposing employees to fall hazards. Abatement certification is required for this item in accordance with the requirements of 29 CFR 1903.19(c).

29 CFR 1926.503(a)(1): The employer shall provide a training program for each employee who might be exposed to fall hazards. The program shall enable each employee to recognize the hazards of falling and shall train each employee in the procedures to be followed in order to minimize these hazards: On or about June 9, 2023, at the above addressed jobsite, employees were working from an elevation greater that 6 feet. The employer failed to ensure an employee training program specific to fall hazards had been developed and maintained. Employees were thereby exposed to the hazards associated with falls from heights. Abatement certification is required for this item in accordance with the requirements of 29 CFR 1903.19(c).
