On or about July 3, 2023, and at times prior thereto, the employer had not developed a written respiratory program that included provisions in 29 CFR 1910.134(c)(1)(i) - (ix) with worksite specific procedures, such as procedures for selecting a respirator for use, medical evaluations, fit testing procedures, procedures and schedules for cleaning, disinfecting, storing, inspecting, repairing, discarding, and otherwise maintaining respirators, and training of employees in respiratory hazards, exposing the employees to various respiratory hazards.

29 CFR 1910.1200(e)(1): The employer did not develop, implement, and/or maintain at the workplace a written hazard communication program which describes how the criteria specified in 29 CFR 1910.1200(f), (g), and (h) will be met. On or about July 3, 2023, and at times prior thereto, the employer did not develop at the workplace a written hazard communication program for hazardous chemicals, such as Full-Base Basecoat Binder, Genesis M Flame Red Paint, and Imron Elite Colorplus Basecoat (PLS), exposing employees to various chemical hazards.
