29 CFR 1926.651(i)(3): Sidewalks, pavements, or appurtenant structures had been undermined and a support system or another method was not provided to protect employees from the possible collapse of such structures:  At the worksite located at 407 Grand Boulevard Kansas City, MO: The employer is failing to protect employees from crush by, caught in, struck by and/or engulfment hazards associated with trenching and excavation. This was most recently documented on or about 07/05/2023. The roadway was undermined so that it could cave-in, and/or collapse. The employer did not provide a support system, and/or other method, to protect employees in the trench and on the roadway.

29 CFR  1926.651(h)(1):Employees were working in excavations in which there was accumulated water, or excavations in which water was accumulating, and adequate precautions had not been taken to protect employees against the hazards posed by water accumulation.  The employer is failing to protect employees from caught in, struck-by, engulfment and electrical shock and/or burn hazards associated with trenching. This was most recently documented on or about 07/05/2023, at a jobsite located at 407 Grand Boulevard KC MO. An employee stated that he had been working in an excavation that had water accumulating in it which compromised the integrity of the trench walls. An employee was exposed to an excavation collapse in the excavation with a depth of greater than 5 feet in depth and approximately 14 feet wide in the hole portion.

29 CFR 1926.651(j)(2): Protection was not provided by placing and keeping excavated or other materials or equipment at least 2 feet (.61m) from the edge of excavations, or by the use of retaining devices that were sufficient to prevent materials or equipment from falling or rolling into excavations, or by a combination of both if necessary.  The employer is failing to protect employees from struck-by and engulfment hazards associated with trenching. This was most recently documented on or about 07/05/2023, at jobsite located at 407 Grand Boulevard, KC MO. The employer did not protect employees from struck-by and engulfment hazards by placing or keeping excavated or other materials at least 2 feet from the edge of the excavation.

The employer is failing to protect employees from struck-by and engulfment hazards associated with trenching and excavation. This was most recently documented on or about 07/05/2023, at jobsite located at 407 Grand Boulevard Kansas City, MO. The employer did not provide or require the use of benching, sloping, shoring or other means to ensure that employees working in excavations were protected from engulfment hazards. The trench was greater than 5 feet in depth.
