29 CFR  1910.95(c)(1):The employer did not administer a continuing, effective hearing conservation program as described in 29 CFR 1910.9(c) through (o) whenever employee noise exposures equal or exceed an 8-hour time-weighted average sound level of 85 decibels measured on the A scale, or equivalently a dose of fifty percent:  Employees were exposed to noise levels exceeding an 8-hour time weighted average of 85 decibels or equivalently a dose of fifty percent, without the employer having a hearing conservation program:   a.   A CNC operator at Bear Bayou #1 thread line was exposed to continuous noise at 148% of the daily noise exposure (8-hour time-weighted average sound level of 85 dBA) or an equivalent sound level of approximately 92.8 dBA during the 444 minute sampling period on July 7, 2023; exposure calculations included a zero increment for the 36 minutes not sampled.  b.   A buck on operator at Bear Bayou #1 thread line was exposed to continuous noise at 167.7% of the daily noise exposure (8-hour time-weighted average sound level of 85 dBA) or an equivalent sound level of approximately 93.7 dBA during the 426 minute sampling period on July 7, 2023; exposure calculations included a zero increment for the 54 minutes not sampled.  c.   An upsetter operator in the forge at Bear Bayou #2b was exposed to continuous noise at 406.8% of the daily noise exposure (8-hour time-weighted average sound level of 85 dBA) or an equivalent sound level of approximately 100.1 dBA during the 427 minute sampling period on July 7, 2023; exposure calculations included a zero increment for the 53 minutes not sampled.  d.   An upset inspector in the forge at Bear Bayou #2b was exposed to continuous noise at 335.1% of the daily noise exposure (8-hour time-weighted average sound level of 85 dBA) or an equivalent sound level of approximately 98.7 dBA during the 427 minute sampling period on July 7, 2023; exposure calculations included a zero increment for the 53 minutes not sampled.  e.   A foreman in the forge at Bear Bayou #2b was exposed to continuous noise at 298.4% of the daily noise exposure (8-hour time-weighted average sound level of 85 dBA) or an equivalent sound level of approximately 97.8 dBA during the 427 minute sampling period on July 7, 2023; exposure calculations included a zero increment for the 53 minutes not sampled.
