OSH ACT of 1970 Section (5)(a)(1):  The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees, in that the employees were exposed to excessive heat:  a) 16 Swift Street, Waterloo, NY 13165, Paneer Reduction Area: On or about July 6, 2023, employees performing heavy work producing, pulling, packing and pressing paneer cheese into metal containers for approximately 8-10 hours were exposed to the hazard of high heat, from the production process in the paneer reduction area. The TSI Questemp 34 WGBT measured a calculated value of 86.4 degrees Fahrenheit (30.2 C) and a heat index 116 degrees Fahrenheit. Such exposures are likely to lead to the development of heat-related illnesses such as, but not limited to, heat cramps, heat stress, heat exhaustion, and heat stroke. Employees experienced, dizziness and flushing of the skin.   b) 16 Swift Street, Waterloo, NY 13165, Pasteurization Area: On or about July 6, 2023, employees performing moderate work in the pasteurization area approximately 8-10 hours were exposed to the hazard of high heat, from the production process in the pasteurization area. The TSI Questemp 34 measured a WGBT calculated value of 89.9 degrees Fahrenheit (32.1 C) and a heat index 123 degrees. Such exposures are likely to lead to the development of heat-related illnesses such as, but not limited to, heat cramps, heat stress, heat exhaustion, and heat stroke. Employees experienced, dizziness and flushing of the skin.  c) 16 Swift Street, Waterloo, NY 13165, Ghee Packaging Area: On or about July 6, 2023, employees performing moderate work in the ghee packaging area for approximately 4-6 hours were exposed to the hazard of high heat, from the production process in the ghee area. The TSI Questemp 34 measured a WGBT calculated value of 84.4 degrees Fahrenheit (29.1 C) and a heat index 103 degrees Fahrenheit. Such exposures are likely to lead to the development of heat-related illnesses such as, but not limited to, heat cramps, heat stress, heat exhaustion, and heat stroke. Employees experienced, dizziness and flushing of the skin.

Employees connect drums of 99.9% Glacial acetic acid with a pH of 2.4 to the processing line to curdle milk creating paneer cheese.   Deep Foods, Inc.  was previously cited for a violation of this occupational safety and health standard or its equivalent standard 1910.151(c) which was contained in OSHA inspection number 1558351 citation number 1, item number 1, and was affirmed as a final order on 4/14/2022, with respect to a workplace located at 1090 Springfield Road, Union, NJ 07083.
