The employer failed to provide certification of abatement for two citations issued on September 21, 2023, with citation 1-1a related to providing a competent person to perform site safety inspections and citation 1-1c related to the safe use of ladders associated with the work task.

It shall be the responsibility of the employer to initiate and maintain such programs as may be necessary to comply with this part; such programs shall provide for frequent and regular inspections of the job sites, materials, and equipment to be made by competent persons designated by the employers.  On or about July 6, 2023, at 147 N Elm Street in Kimberly, Wisconsin, the employer did not ensure that a competent person was performing frequent and regular inspections that could have recognized fall from elevation hazards, struck-by hazards, ladder hazards, and tripping hazards.

29 CFR  1926.100(a): Employees working in areas where there is a possible danger of head injury from impact, or from falling or flying objects, or from electrical shock and burns, shall be protected by protective helmets.   On or about July 6, 2023, at 147 N Elm Street in Kimberly, Wisconsin, an employee who was not wearing a hard hat was exposed to a potential struck-by hazard while working below a roof eave with a shingle scraping tool on the roof.

29 CFR  1926.1053(b)(4):  Ladders shall be used only for the purpose for which they were designed.  On or about July 6, 2023, at 147 N Elm Street in Kimberly, Wisconsin, employees were exposed to a potential fall hazard greater than six (6) feet while descending an extension ladder without following manufacturer's recommendations.  Two employees were using the ladder at the same time.

29 CFR  1926.1053(b)(9): The area around the top and bottom of ladders shall be kept clear.   On or about July 6, 2023, at 147 N Elm Street in Kimberly, Wisconsin, employees who were using a roof access/egress ladder were exposed to trip hazards at the top and base of the ladder.  Roofing material debris was around all sides of the ladder base and at top of the ladder.

Each employee engaged in residential construction activities 6 feet (1.8 m) or more above lower levels shall be protected by guardrail systems, safety net system, or personal fall arrest system unless another provision in paragraph (b) of this section provides for an alternative fall protection measure.  On or about July 6, 2023, at 147 N Elm Street in Kimberly, Wisconsin, employees were exposed to fall from elevation hazards working on a roof 11.5 feet above surface level without using fall protection equipment.  The  Cruz Roofing LLC was previously cited for a violation of this occupational safety and health standard or its equivalent standard 1926.501(b)(13), which was contained in OSHA inspection number 1647945, citation number 02, item number 01a and was affirmed as a final order on March 20, 2023, with respect to a workplace located at 2220 E Downs Ridge; Appleton, WI  54913.  The Cruz Roofing LLC was previously cited for a violation of this occupational safety and health standard or its equivalent standard 1926.501(b)(13), which was contained in OSHA inspection number 1633505, citation number 02, item number 001 and was affirmed as a final order on March 21, 2023, with respect to a workplace located at 231 Countryside Ct.; Waupaca, WI  54981. 29 CFR  1926.503(b)(1):  The employer shall verify compliance with paragraph (a) of this section by preparing a written certification record.  The written certification record shall contain the name or other identity of the employee trained, the date(s) of the training, and the signature of the person who conducted the training or the signature of the employer.  If the employer relies on training conducted by another employer or completed prior to the effective date of this section, the certification record shall indicate the date the employer determined the prior training was adequate rather than the date of actual training.   On or about July 6, 2023, at 147 N Elm Street in Kimberly, Wisconsin, the employer did not provide required fall protection safety training certification for employees who were exposed to fall hazards greater than six feet while working on a roof surface with unprotected edges. 29 CFR  1926.1053(b)(1): When portable ladders are used for access to an upper landing surface, the ladder side rails shall extend at least 3 feet (.9 m) above the upper landing surface to which the ladder is used to gain access; or, when such an extension is not possible because of the ladder's length, then the ladder shall be secured at its top to a rigid support that will not deflect, and a grasping device, such as a grabrail, shall be provided to assist employees in mounting and dismounting the ladder. In no case shall the extension be such that ladder deflection under a load would, by itself, cause the ladder to slip off its support.   On or about July 6, 2023, at 147 N Elm Street in Kimberly, Wisconsin, employees were exposed to a potential fall from elevation hazard while using an extension ladder to access/egress a roof surface 11.5 feet above surface level without the side rails extended at least 3 feet above the roof edge.  The ladder side rails were extended 12 inches above the roof edge.
