29 CFR 1910.95(c)(1): The employer did not administer a continuing, effective hearing conservation program as described in 29 CFR 1910.9(c) through (o) whenever employee noise exposures equal or exceed an 8-hour time-weighted average sound level of 85 decibels measured on the A scale, or equivalently a dose of fifty percent: A continuing, effective hearing conservation program (including the elements of noise monitoring, employee notification, audiometric testing, hearing protection, training, information, and recordkeeping) was not administered for instances such as, but not limited to: a) On July 23, 2023, an employee operating Collator 7 was exposed to noise at 125% of the permissible daily dose as measured over 568 minutes of sampling on a 10 hour shift. This dose is equivalent to an 8-hour TWA exposure of 91.6 dBA accounting for the period of 32 minutes unmonitored. b) On July 23, 2023, an employee operating Press 7 was exposed to noise at 81.9% of the permissible daily dose as measured over 604 minutes of sampling on a 10 hour shift. This dose is equivalent to an 8-hour TWA exposure of 88.5 dBA. c) On July 23, 2023, an employee operating Press 10 was exposed to noise at 79.6% of the permissible daily dose as measured over 563 minutes of sampling on a 10 hour shift. This dose is equivalent to an 8-hour TWA exposure of 88.3 dBA accounting for the period of 37 minutes unmonitored. d) On July 23, 2023, an employee operating Press 17 was exposed to noise at 139.7% of the permissible daily dose as measured over 550 minutes of sampling on a 10 hour shift. This dose is equivalent to an 8-hour TWA exposure of 92.4 dBA accounting for the period of 50 minutes unmonitored.
