29 CFR  1910.146(d)(5)(ii): Employer did not ensure that the permit space was tested or monitored as necessary to determine if acceptable entry conditions were being maintained during the course of entry operations:  a. On or about July 17, 2023, the employer did not ensure that employees entering a tank wagon, a permit-required confined space, were provided with appropriate equipment to test and monitor the space to determine if acceptable entry conditions were being maintained during the course of entry operations.  Employees were provided with a TPASS 3, which monitors movement of entrants not atmospheric conditions.

29 CFR  1910.178(p)(1): Power industrial vehicle(s) found to be in need of repair, defective, or in any way unsafe had not been taken out of service until restored to safe operating condition(s):  a. On or about July 17, 2023, employees were exposed to stuck-by hazards,  when required to operate a HYDA, Model: 25L-7A,  S/N: HHKHHF08AJ0004296, equipped with a clamps not kept in safe working condition. The  lamps were damaged (rutted) and not working properly to carry heavy equipment, and was not removed from service.  b. On or about July 17, 2023, employees were exposed to stuck-by hazards,  when required to operate a HYDA, Model: 25L-7A, S/N: HHKHHF08TH0004091, equipped with a clamps not kept in safe working condition. The  lamps were damaged (rutted) and not working properly to carry heavy equipment, and was not removed from service.   c. On or about July 17, 2023, employees were exposed to stuck-by hazards,  when required to operate a HYDA, Model: 25L-7A, S/N: HHKHHPF0EK0005244, equipped with a clamps not kept in safe working condition.
