29 CFR 1910.178(I)(1)(ii): The employer did not ensure that each operator had successfully completed the training required by paragraph (I), except as permitted by paragraph (I)(5), prior to permitting an employee to operate a powered industrial truck:  On July 5, 2023, and times prior to, employees of Select Drink, Inc. operated powered industrial trucks at a commercial building located at 5757 North Lindbergh Boulevard,  Hazelwood, Missouri.  The employer did not ensure that employees received a combination of formal instruction (e.g., lecture, discussion, interactive computer learning, video tape, written material), practical training (demonstrations performed by the trainer and practical exercises performed by the trainee), and an evaluation of the operator's performance in the workplace prior to permitting each employee to operate a powered industrial truck.

29 CFR 1910.178(p)(l): Powered industrial truck(s) found to be in need of repair, defective, or in any way unsafe had not been taken out of service until restored to safe operating condition(s):  On July 5, 2023, and times prior to, Select Drink, Inc. did not ensure powered industrial vehicles were removed from service when found to need repair, defective or in any way unsafe. An employee operating a Clark CGP25, Serial # P365L-0959-9489FB powered industrial truck was found to be missing the seat belt assembly and the backup horn was non-operational.
